Subject
This regulation forms the basis for all courses, tours, events and offers booked at trailblazer.bike (Philipp Zimmermann, Schuppisstrasse 4, 8057 Zurich), unless otherwise agreed in writing in individual cases. These terms and conditions are an integral part of all individual contracts between trailblazer.bike and the customer.
Registrations and payment terms
Registration is done online via email or by direct contact on the offer page on www.trailblazer.bike, by email to philipp@trailblazer.bike or orally. A person is considered registered when they have received written confirmation of their booking by email from trailblazer.bike. The confirmation of booking will include an invoice with banking details and a payment deadline of 10 days. One-day events must be paid for at the latest on the day of the event. Multi-day events must be paid for 14 days in advance. By registering, the customer agrees that trailblazer.bike may use their data (personal data, booked events, photos, etc.) for its own purposes (advertising, information about new offers, etc.). trailblazer.bike does not pass on customer data to third parties.
Withdrawal by a participant
The customer can withdraw from the offer at any time before the event begins. The withdrawal statement must be made in writing.
For one-day offers, the following cancellation fees apply:
Until 14 days before the event, free withdrawal applies (administration costs of CHF 20 must be borne)
From 14 days before the event, 25% of the event price will be charged
From 7 days before the event, 50% of the event price will be charged
From 2 days before the event or in case of non-attendance, 100% of the event price will be charged
For multi-day offers, the following cancellation fees apply:
Until 28 days before the event, free withdrawal applies (administration costs of CHF 30 must be borne)
From 28 days before the event, 40% of the event price will be charged
From 14 days before the event, 70% of the event price will be charged
From 7 days before the event or in case of non-attendance, 100% of the event price will be charged
The cancellation fees will be waived if a replacement participant is found. In this case, only administration costs of CHF 20 or 30 will be charged.
For offers with services of third parties (e.g. hotel, flight, transport, etc.), the same cancellation fees apply plus any cancellation costs of the service provider, which will be charged by trailblazer.bike to the customer. The time of receipt of the withdrawal statement by trailblazer.bike is decisive. No refunds can be made due to premature termination of an event or reasons outside the influence of the organizer. The customer is recommended to take out cancellation cost insurance.
Withdrawal by the organizer
We reserve the right to cancel or prematurely terminate tours in case of very bad weather conditions, forces of nature, accident and force majeure events. In case of cancelled or postponed events, payments already made by customers will be refunded. In the event of early termination of events due to very bad weather conditions, forces of nature, accidents and events of force majeure, the customer / the customer has no right to reimbursement of outstanding services of the organizer. Further claims are excluded.
Terms of participation
The customer is obligated to abide by the following rules:
• Participation with a technically sound bike
• Wear appropriate safety equipment (helmet is mandatory)
• Wear and bring clothing suited to the weather, location and season
• Bring drinks, food and personal medication
• Bring specific equipment and tools, especially charger and charged batteries for e-bikes
• Acting responsibly, particularly assessing whether a trail is within one’s abilities and can be ridden or if it should be pushed or carried
• Respectful behavior towards the environment and other people, especially other course participants, hikers and train users
• Reporting of allergies (e.g. bees) to the guide before the tour
• Following the instructions of the bike guide during the event
• Possessing the skills and experiences required in the description
trailblazer.bike reserves the right to exclude participants from the event immediately for non-compliance with individual rules.
General regulations
The participation in the event is generally at one’s own risk and at one’s own risk. The participants are aware of this and agree that the course of the event and the duration of the event – for example, due to weather and road conditions – can be subject to changes at any time and, in particular, that the time of the return journey may be moved forward or backward. The participants must, in particular, evaluate for themselves whether they can safely ride a section of the trail with a mountain bike without endangering themselves or others. In case of doubt, a section of the trail should be viewed beforehand and/or the mountain bike should be pushed or carried. The organizer or its agents are not obligated to provide for the security of the route or to point out hazards.
Liability
trailblazer.bike assumes responsibility towards the participant as organizer for a careful selection, organization and procurement of the agreed travel, services and services.
Exclusion of liability
trailblazer.bike is not liable for damages to bicycles and luggage incurred during transportation (by air, train, ship, bus, etc.) or for theft of the bicycle while on the trip. Insurance for bicycles and luggage is the responsibility of the participants. trailblazer.bike strongly recommends purchasing travel and baggage insurance. Participants are also liable for damages or loss of rental equipment and test bikes provided by trailblazer.bike.
For activities and excursions booked with external providers at the destination, trailblazer.bike assumes no liability.
Mountain biking carries an increased risk of accidents (falls, collisions with motorized traffic, rockfall in the mountains, etc.). A significant degree of personal responsibility and caution is therefore expected of each participant.
In addition, trailblazer.bike is not liable for personal or property damage caused by the poor condition of bikes, including rental and test bikes, which may incur damage or excessive wear during use or transportation.
Insurance
Insurance coverage during the event is the responsibility of the participant. For all events organized by the provider, any liability is excluded.
Visuals
The resulting film and image material (on which participants are depicted) may be used by trailblazer.bike for documentations and advertising in any form – provided that no counter-report of the participating person is available.
Closing provisions
trailblazer.bike may amend these General Terms and Conditions at any time. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. Instead, the invalid provision will be replaced by a substitute provision that corresponds or at least comes close to the purpose of the agreement, which the parties would have agreed upon to achieve the same economic result, if they had known of the invalidity of this provision.
trailblazer.bike and the customer undertake to attempt to reach an amicable settlement in the event of a disagreement before the matter is brought before a judge, and to at least give the other party sufficient opportunity to make a written statement. This provision as well as all underlying individual contracts shall be governed by Swiss law. The place of jurisdiction for all disputes arising from this contract is the court responsible for the registered office of trailblazer.bike.
